    I was recently hired as a per-diem registered nurse at a big hospital. I went through a 3-day hospital orientation, and my actual first day on the unit was a month away. The hospital told me to complete online orientation content from home, saying that it would take approximately 1 hour. However, the required education took 6.5 hours to complete, because it was a huge amount of material. For example, a section on pressure ulcers took 2 hours and included stringent testing. The compliance section was 63 pages of material, and I had to score 100% on the test to pass it. I appreciate that these aren't mindless tests; however I feel that I ought to be paid for the 6.5 hours of work. If I am required to do this, shouldn't I be paid? Because this is a new job, I'm not sure how I should approach this. I am afraid that I won't make it past my probationary period!

    Answer: Arm Yourself With the Facts
    Because the hospital required you to read the material and take the tests, they must pay you for the time you worked on that project. It doesn't matter whether it was an hour or more than an hour. A good resource is US Department of Labor Fact Sheet #53, The Health Care Industry and Hours Worked. (The fact sheet includes the number for a toll-free information/help line).

    The problem in this scenario is how to approach it. It is possible that the hospital administration understands that they need to pay you, but no one has taken the time to inform you of the process. One approach is to ask the individual who gave you the assignment about the process for submitting the hours spent. Another approach is to ask the Human Resources department how you should submit those hours. A third possibility is to type up a record of the project and the hours spent and submit it to the individual who gave you the project. If the hospital declines to pay you, resubmit the hours with a copy of this article and the fact sheet referenced above and ask for a response.

    Hospital and facility administrators, and managers, including those in the facility's education department, have a responsibility to know the basics of wage and hour law and should read the Department of Labor Fact Sheet #53, particularly the sections on "Training and Seminars" and "Unauthorized Hours Worked."
